    Question About Breeder Loans

    I'm thinking about entering a breeding loan with a member here who I have a good amount of trust in.

    I had a couple of questions; I know there was a great thread with some breeder contract info but I can't seem to find it with the search.

    I would be loaning out one of my snakes to the care of the other person. What arrangements have some of you made to split the offspring?

    What sort of stipulations are beneficial to have in the written contract. Some things I can think of are responsibility of vet bills should the loaned animal get sick, shipping cost of the loaner/offspring, ect.

    This is my first loan so I'm looking for any advice from people who have done loans in the past.

    I have done loans before, and have a contract that I had written up with a fellow herper that is on this site a couple of years ago.

    Depending on the animals in question, you can go 50/50 split with first pick going to the person with the more expensive animal, or... depending again on the animal, first pick and the rest going to the person who incubated the eggs, etc...

    It's really dependant on what you and the other person feels is fair.

    AND!! You HAVE TO plan for the inevitable problems that may arise, as in health issues, deaths, etc. YOU CANNOT leave any stone unturned, as something complicated or unplanned can ruin your animal and your friendship with the person that you are in the loan with.

    Some stipulations I had on there was: Death, health care, feeding of babies, limit to the time that the animals were in the other persons care, etc...

    Here is a copy of the contract:

    X agrees to lend his adult ---- male ball python to
    Y for breeding purposes from March until such time as the
    breeding season is over, but no later than (Month, Day, Year) if the
    snakes do not produce. Y will send her male ---- ball python to
    X in accordance to the agreement in which the male animals (X's
    and Y's) will be traded as collateral for the breeding season.
    X is responsible for the transportation (thru UPS, Fedex, or Delta
    Dash overnight) of his snake to the residence of Y in an
    appropriately heated and controlled box and environment, and X is
    likewise financially responsible for the transportation back to
    Y's residence in an appropriately heated and controlled box and
    environment (thru UPS, Fedex, or Delta Dash overnight) for her male
    ----. If said snakes are received upon shipping as dead on arrival,
    either party must notify the other immediately within 24 hours. Either
    party must provide proof of the dead snake and send it back to the
    owner as soon as possible. A necropsy must be done to determine the
    mode of death, and if the fault falls on either party after the
    necropsy, said party will be held accountable.
    Y shall feed and house said animals in the appropriate fashion,
    and will send pictures and update X on a weekly basis as to the
    health and housing of the snakes. Y agrees not to replace or
    steal said snakes, or intentionally harm or intentionally create an
    environment where said snakes will become ill. If the female snakes,
    belonging to Y, do become gravid and produce eggs, this shall be
    properly documented and photographed to send to X immediately. The
    eggs shall be handled properly and if said eggs hatch, the share of
    the clutch is as follows: the clutch will be split evenly by sex and
    by morph, unless such time as there is an uneven amount of eggs, by
    which X will acquire the final odd female pastel hatchling. Normals
    will be given to Y, but not if there is a large amount of normal
    females in the clutch. At no point will there be an uneven share of
    the hatchlings unless discussed and agreed upon. Every snake shall be
    documented and sexed accordingly, and be fed and cared for until which
    time as the hatchlings achieve a minimum weight of 100 grams. At that
    time and not before shall the hatchlings be sent to X. If at this
    time the adult male ---- is not sent back, they can all be sent back
    together with the hatchlings in the appropriate boxes. This contract
    will terminate when the duties described above have been completed.
